General terms and conditions
MÉLUNÉE Paris Kft. · Provider details as stated in the legal notice · [email protected]
Last updated: 16.09.2026 · Version 2026-09-16-v1
1. Provider, scope and contract language
These terms and conditions apply to consumer orders placed through the online shop at melunee.com. The provider is MÉLUNÉE Paris Kft.; full provider and registration details are published in the legal notice. Customer service: [email protected].
For the German-language shop, the contract language is German. Other language versions may be made available; in the event of inconsistencies, the version displayed and incorporated when the contract is concluded prevails.
A customer's differing terms apply only if MÉLUNÉE has expressly agreed to their application.
2. Ordering process and conclusion of the contract
Product listings in the shop do not yet constitute a binding contractual offer. Customers can select products and variants, add them to the shopping basket, and check and correct their entries before submitting an order.
By clicking the final order button indicating an obligation to pay, the customer makes a binding offer to conclude a purchase contract for the goods listed at checkout.
Receipt of the order is acknowledged electronically. A mere acknowledgement of receipt does not necessarily constitute acceptance of the offer. Acceptance takes place through an express order or payment confirmation containing a declaration of acceptance, or through dispatch of the goods, whichever occurs first.
Order and contract data is stored in accordance with statutory and operational retention obligations. Registered customers can also view their orders in their customer account.
3. Products, availability and variants
The product description, the selected variant, the quantity shown at checkout and the price stated there are decisive.
For fashion, beauty and perfume products, images may differ slightly from the actual appearance owing to screen rendering, lighting or production batches, provided this does not change any guaranteed product characteristic.
If an ordered item is exceptionally unavailable, MÉLUNÉE informs the customer without undue delay. Payments already received for goods that cannot be delivered are refunded.
Items in the Second Hand category are used or previously owned goods. The specific condition and visible signs of wear stated in the product description form part of the agreed condition of the goods.
4. Prices, market, currency, taxes and shipping costs
The prices shown to consumers in the shop are final prices including any applicable statutory VAT, insofar as it is payable. Shipping costs and other costs directly related to the order are shown no later than at checkout, before the order is placed.
The market selected by the customer determines the currency displayed in the shop and, where technically supported, used for payment at checkout. The shop language is selected independently. The total amount displayed at checkout immediately before the order is placed, in the currency stated there, is decisive for the order.
When converting from an internal EUR base, the exchange rate used for the order and the customer's currency are recorded for that transaction. An order that has already been completed is not subsequently recalculated using a more recent exchange rate.
Deliveries to countries outside the EU customs territory may incur import duties, import VAT or clearance fees. Whether these amounts are included in the displayed price or shipping arrangement is indicated at checkout and in the shipping information. Unless they are shown there as being covered by MÉLUNÉE, the recipient may owe them to authorities or shipping providers.
5. Payment
The payment methods offered at checkout apply. For card payments or comparable payments, payment data is processed through the payment provider used.
Where Stripe is used as the payment provider, MÉLUNÉE does not receive full card details; it processes, in particular, payment status and payment references needed to process and associate the order.
If a payment cannot be successfully authorised or completed, there is no entitlement to dispatch of the goods until the payment due has been received.
6. Vouchers, discount vouchers and bonus credit
Discount or goodwill vouchers can be redeemed at checkout in accordance with the conditions communicated when they are issued. Where a validity period, single use or a specific scope has been set for a voucher, those details are decisive.
MÉLUNÉE bonus credit shown in the customer account can, where available at checkout, be applied against the value of goods and standard shipping costs without a minimum order value. Unused bonus credit remains available until used or until an expressly communicated expiry date.
Discount vouchers and voluntary bonus credit are not paid out in cash unless mandatory law or an express individual agreement requires otherwise. They cannot reduce the amount payable for an order below zero.
Voluntary goodwill benefits, price credits or bonus credit do not constitute acknowledgement of a statutory obligation in the absence of an express declaration and do not affect mandatory consumer rights.
7. Delivery, shipping, transfer of risk and tracking
Delivery is available to the delivery areas selectable at checkout. The delivery options, shipping costs and any country-specific information displayed there are decisive.
The expected delivery time is stated in the shop, at checkout or in order communications. Delays beyond MÉLUNÉE's reasonable control are communicated to the customer where possible.
For consumers, the risk of accidental loss or accidental deterioration generally passes only when the goods are handed over to the consumer or a person designated by them who is authorised to receive them, unless mandatory law provides otherwise.
After handover to the shipping provider, the provider, tracking number, shipping status and tracking link may be displayed in the customer account.
8. Retention of title
Delivered goods remain the property of MÉLUNÉE until the purchase price is paid in full, to the extent that such retention of title is permitted under the applicable law.
9. Right of withdrawal
Consumers whose orders are subject to European distance-selling law generally have a 14-day right of withdrawal. Details of the period, how to exercise the right, its effects and statutory exceptions are described on the Right of withdrawal page.
Withdrawal may be declared using the online withdrawal function provided on melunee.com, by a clear statement sent by email to [email protected], or by another legally permitted means. Use of the returns centre is not a condition for a statutory withdrawal to be valid.
Second-hand goods are excluded from MÉLUNÉE's voluntary goodwill returns or voluntary returns option. This exclusion does not affect an existing statutory right of withdrawal or statutory rights relating to defects.
10. Returns and return shipping costs
For eligible orders, a return can be created through the customer account after delivery. This technical function supplements statutory rights and does not replace them.
If MÉLUNÉE provides a standard return label for a withdrawal or a voluntarily accepted return and it is used, MÉLUNÉE bears the direct cost of that standard return. If a different or more expensive shipping method is chosen without prior agreement, the customer may remain responsible for the resulting additional costs to the extent permitted by law.
If no free MÉLUNÉE return label has been provided and MÉLUNÉE has not otherwise undertaken to cover the costs, the consumer bears the direct return costs in the case of a statutory withdrawal, to the extent that this has been validly agreed and communicated under the applicable law.
Statutory rights remain unaffected in the case of defective goods or incorrect deliveries; necessary costs of handling a justified defect claim are not passed on to the consumer contrary to mandatory law.
11. Reimbursements and refund currency
In the event of a valid withdrawal, payments to be refunded by law, including the cost of the least expensive standard delivery offered, are generally reimbursed through the same payment method used for the original transaction, unless otherwise agreed.
For purchases of goods, MÉLUNÉE may withhold reimbursement to the extent permitted by law until the goods have been received back or the customer has provided evidence of their return.
Refunds, partial reimbursements and goodwill amounts are calculated using the data of the original transaction. For payments in a different customer currency, a completed order is not revalued using a later exchange rate.
A processing status shown in the customer account does not automatically mean that the payment provider has already completed the technical refund transfer. The actual refund status is processed separately.
12. Rights relating to defects and guarantees
Statutory rights in respect of defective goods apply. These terms and conditions do not restrict mandatory consumer rights.
For second-hand goods, assessment of the agreed condition takes into account the used condition specifically described in the product listing and expressly identified signs of wear; mandatory rights relating to defects that were not agreed remain unaffected.
If an additional manufacturer's guarantee or voluntary guarantee exists for an individual product, its conditions are stated separately with the product or in the accompanying documents. A voluntary guarantee does not affect statutory rights relating to defects.
13. Liability
MÉLUNÉE is liable in accordance with mandatory statutory provisions. In particular, no limitation of liability applies in cases of intent, gross negligence or damage arising from injury to life, body or health, to the extent that the applicable law does not permit such a limitation.
In all other respects, liability is governed by the applicable law and the nature of the contractual obligation breached.
14. Complaints and out-of-court dispute resolution
Complaints can be sent to [email protected]. For order-related enquiries, please include the order number wherever possible.
Before involving a conciliation body, the customer should first try to resolve the matter directly with MÉLUNÉE.
The consumer and conciliation bodies competent under the applicable law are available for consumer disputes. For the company's registered office in Hungary, the consumer protection and conciliation procedures provided there apply in particular.
The former EU online dispute resolution platform (ODR) has been discontinued and is no longer linked as a complaints channel.
15. Applicable law and mandatory consumer protection
Hungarian law generally applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent that this choice of law is permitted.
For consumers, this choice of law does not deprive them of the protection afforded by mandatory provisions of the law of their habitual residence that would apply in the absence of a choice of law.
16. Final provisions
If individual provisions are or become invalid, the validity of the remaining provisions remains unaffected in accordance with the applicable law.
MÉLUNÉE may amend these terms and conditions for future orders. For an order that has already been completed, the version incorporated at the time the contract was concluded generally applies.
