Withdrawal instructions

Right of withdrawal

For a distance contract falling within the scope of European consumer law, consumers generally have the right to withdraw from the contract within fourteen days without giving a reason. Other statutory rules may apply to deliveries to countries outside this scope; any voluntary MÉLUNÉE return rights remain separate.

For a contract for the sale of goods, the withdrawal period is fourteen days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods. If several goods in a single order are delivered separately, the period generally begins upon receipt of the last item; for goods delivered in several lots or pieces, it begins upon receipt of the last lot or piece respectively.

Exercising the right of withdrawal

To exercise the right of withdrawal, the consumer must inform MÉLUNÉE of their decision to withdraw from the contract by a clear statement before the withdrawal period expires. To meet the deadline, it is sufficient to send the statement of withdrawal before that period expires.

Withdrawal may be declared, in particular, using the online withdrawal function, by email or using the model withdrawal form below. The returns centre in the customer account makes returning goods easier, but using it is not a condition for a statutory withdrawal to be valid.

Effects of withdrawal

In the event of a valid withdrawal, MÉLUNÉE reimburses the amounts repayable under statutory provisions, including the cost of the least expensive standard delivery offered. Additional costs resulting from a more expensive delivery method expressly chosen by the consumer do not have to be reimbursed.

Reimbursement is made without undue delay and generally no later than fourteen days after receipt of the statement of withdrawal. Unless otherwise agreed, reimbursement generally uses the same means of payment as the original transaction. For purchases of goods, MÉLUNÉE may withhold reimbursement to the extent permitted by law until the goods have been received back or evidence of their return has been provided.

Returning the goods

The goods must be returned without undue delay and generally no later than fourteen days after the statement of withdrawal is made. The return address or an available return label is provided during the returns process.

If MÉLUNÉE provides a standard return label and it is used, MÉLUNÉE bears the direct cost of that standard return. If no free label is provided and no other undertaking to cover the costs has been given, the consumer bears the direct return costs to the extent that this is validly provided for under the applicable law. For justified claims concerning defective goods or incorrect deliveries, the statutory rules on costs apply.

Diminished value

The consumer may be responsible for a reduction in the value of the goods only if that reduction results from handling beyond what was necessary to establish the nature, characteristics and functioning of the goods.

Second Hand

Right of withdrawal for second-hand goods

Second-hand goods sold online commercially to consumers are not categorically excluded from the statutory right of withdrawal either. The applicable statutory conditions and exceptions remain decisive.

Second-hand goods are excluded from MÉLUNÉE's voluntary goodwill returns and voluntary returns option. This exclusion does not affect an existing statutory right of withdrawal or restrict statutory rights relating to defects.

The used condition described in the relevant product listing and any specific signs of wear stated there remain part of the agreed condition of the goods.

Statutory exceptions to the right of withdrawal

The right of withdrawal does not exist, or may expire early, in particular where a statutory exception applies. These include, among other things, goods made to the customer's specifications or clearly personalised goods.

An exception may also apply to sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

MÉLUNÉE does not categorically treat every opened beauty or perfume product as excluded from withdrawal. What matters is whether the statutory requirements of the relevant exception are actually met in the specific case.
